Terms of Service & End User License Agreement (EULA)

MANDATORY REGULATORY & FINANCIAL RISK DISCLOSURE:
MyTrade is a quantitative analytical and decision-support software application. MyTrade is NOT a registered broker-dealer, investment adviser, or financial planner, and does not provide personalized investment advice. Options trading involves substantial risk of loss and is not suitable for all investors. Prior to trading, you must receive and review the Characteristics and Risks of Standardized Options (ODD) published by the Options Clearing Corporation (OCC).

1. Agreement to Terms

By downloading, installing, accessing, or using the MyTrade mobile application (iOS), watchOS application, or web platform (collectively, the "Application"), you agree to be bound by these Terms of Service and End User License Agreement. If you do not agree to these terms, do not install or use the Application.

2. Nature of Software & Non-Broker-Dealer Status (Apple Guideline 3.1.5)

MyTrade provides mathematical formulas, Black-Scholes Greek estimations, downside cushion calculations, and order staging interfaces for systematic options strategies (including Cash-Secured Puts, Covered Calls, and The Wheel). You explicitly acknowledge and agree that:

MyTrade is purely a technological software platform and decision-support tool.
MyTrade does not solicit, route, hold, custody, clear, or execute securities or options transactions directly.
All live execution occurs strictly through your independent, self-directed brokerage account (such as E*TRADE from Morgan Stanley or brokerages linked via SnapTrade) via authorized API protocols.

3. Human-in-the-Loop & Execution Authorization

MyTrade adheres to strict Human-in-the-Loop (HITL) principles. No trades are executed automatically without your explicit pre-flight review and affirmative authorization. You are solely and exclusively responsible for evaluating the pricing, liquidity, suitability, margin impact, and risks of any trade staged or submitted through the Application.

4. Options Trading Risks

Trading options involves significant financial risk. Short options positions (such as Cash-Secured Puts) subject the seller to substantial downside assignment risk if the underlying stock price declines. You may lose up to 100% of the collateral assigned or more in margin accounts. Past performance, backtested projections, and annualized return-on-risk metrics generated by the software are hypothetical, do not reflect real trading costs, and do not guarantee future results.

5. License Grant & Intellectual Property

Subject to your compliance with these Terms, MyTrade grants you a limited, non-exclusive, non-transferable, revocable license to use the Application on Apple-branded devices that you own or control, in accordance with the Apple Media Services Terms and Conditions.

6. Disclaimer of Warranties

THE APPLICATION AND ALL CONTENT, ALGORITHMIC SCORES, MARKET DATA, AND SERVICES PROVIDED THROUGH IT ARE DELIVERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MYTRADE DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND ACCURACY OF REAL-TIME MARKET QUOTES.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYTRADE TECHNOLOGIES INC., ITS OFFICERS, DIRECTORS, OR DEVELOPERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, TRADING LOSSES, CAPITAL DEPLETION, SYSTEM DOWNTIME, OR DATA LOSS ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.
